Affidavit for Criminal Charges

  2. You are accessing the Jonesboro City Attorney’s electronic affidavit form to press criminal charges. In order to file an affidavit for criminal charges, you or your minor child must be the victim of a crime that occurred within the city limits of Jonesboro. NOTE: If it is not your intention to press criminal charges but you are seeking an Order of Protection, please see the FAQ section. 

    Upon completion of the electronic affidavit form, a prosecutor will review your affidavit and the evidence provided to determine if the allegations fit an Arkansas criminal statute. If approved, a criminal case will be initiated by the prosecutor and either a Summons to Appear in Court or a Warrant of Arrest will be issued.

    The Jonesboro City Attorney’s jurisdictional authority is limited to misdemeanor crimes which are committed by an adult, within the city limits of Jonesboro.  If the crime you are reporting does not fit these parameters, see the FAQ section for further guidance.

  8. POTENTIAL DEFENDANT:
    When completing the affidavit form, the person you want to press charges on is the “potential defendant”. You must have the potential defendant’s name to proceed. If you do not have the potential defendant’s name, your affidavit will be denied.

    NOTE: If there is more than 1 defendant you will need to file a separate affidavit for each defendant.

    Defendant’s Identifying Information:
    A name is required, criminal charges cannot be issued without the defendant’s name. Additional identifying information such as a date of birth or social security number can be helpful.

    Defendant’s Contact Information:            
    Contact information such as address, phone number, workplace and email address is essential in locating and serving the defendant with the charges. Contact information for the  potential defendant is not required to file an affidavit. However, for the case to be prosecuted, the defendant must be served by a law enforcement official with a court date. If the defendant cannot  be located, the case will not be served and the defendant cannot be convicted.
